Yes, confidence should be full before sending.

Sending employees that arent showing FULL confidence is a waste of time.

Great guide and great discussion, thanks for writing this up.  Here's one question I haven't seen discussed yet:

Has anyone done any testing around whether or not having a higher "Strategy" increases changes of success for landmark negociations?  I thought it might as it increases employee execution and management, and thus likely confidence.

When you mouse-over Strategy it says, in big yellow letters: "Improves the attack effect of Price Strategies". (If you dont get a mouse over popup, refresh and try again).

I mean, BTO has gone OUT OF ITS WAY, like it has in no other place, to tell you that Strategy has a VERY LIMITED effect. Its effect does NOT include: NPC Landmark, employee poaching or any other negotiations. I have seen them reiterate this in forum responses.

The key to win NPC Negotiation is the execution, management and confidence of the employee you delivered to the negotiation, the higher they are, the more probability to win. In addition, the higher level your company is , the more NPC LANDMARKS you can choose. Employee Talent has nothing to do about it. Thank you!

Assuming that the computer chooses blue employees for its NPC team (regardless of "strength" of landmark) and it is up to a combination of employee experience, management, confidence vs NPC employee (randomly matched up), then there is an advantage to higher level companies, simply by virtue of needing less wins to pull off a 1600+ NPC score and earn a NEC. So, yes, some luck involved, but really, the formula favors bigger companies by virtue of the number of employees that can be sent. Even if there is only random chance (meaning it doesn't matter if you use blue, green, purple, red, orange, polka dot level employees), then the odds are not really in your favor until you reach Multi. Corp., where you only need to win 2/3 of your matchups. In fact, Tiger Beach Hotel is the most efficient place to battle (assuming that the NPC team is not made up of all oranges, etc.) requiring only 21 wins. If your company is only Group, your best bet is the Sailboat Hotel, if you are Limited, go to Thunder Intl Building, if you are Large, go to MG TV Tower, if you are Medium/Small...well leave NPC landmarks alone and get upgraded already! lol.

Some quick numbers using the formula provided (Score = 50(4W-2T-3) + (1150(W/T)) *With W=Winning employees and T=Maximum number of employees able to be sent

A few seconds after the npc landmark negociation begins, those employees who lose confidence are updated in employee overview screen, and you see how many lost before the end of the negociation.
I can confirm that giving popcorns during negociation wont affect the outcome
